I filed Chapter 7 bankruptcy in 2004. I had just financed a vehicle, which I did not include in the bankruptcy and have made my monthly payments on time ever since.
I recently reviewed my credit report and noticed there is nothing listed about my car or the payments that I have been making. It does not even show an existing auto loan -- absolutely nothing about the car at all.
I called the finance company and
they told me that I am making a "voluntary
payment."
What is a voluntary payment and since I am making a voluntary payment can I voluntarily give the car back or let them pick it up?
You can ask the credit reporting bureau to include the car loan in its report. Since you didn't discharge the debt in your bankruptcy, the contract is still binding. There is nothing "voluntary" about it -- except of course all loan payments are voluntary in the sense that you can stop making them and suffer the consequences.
On the other hand, don't expect that a report that you're making car payments on time will quickly outweigh the negative assessment of the bankruptcy.
