United States Law Governs this Sweepstakes

ELIGIBILITY: United States law governs this sweepstakes. This sweepstakes is open only to legal residents of the United States who are 18 years of age or older at time of entry. Employees and their immediate families, including household members, of Bankrate, Inc., ("Bankrate, Inc.") its affiliates, subsidiaries, divisions, advertising and promotion agencies are not eligible. This sweepstakes is subject to all federal, state, and local laws of the United States. Void where prohibited. Bankrate, Inc. reserves the right to verify eligibility qualifications of any Winner. Bankrate, Inc. will not enter into correspondence, including e-mail.

HOW TO ENTER: From April 1, 2003 through June 30, 2003 (the "Entry Period"), Bankrate, Inc. will conduct a national sweepstakes whereby one (1) Grand Prize Winner will receive a check for $5,000.

You can enter this sweepstakes either by mail or online. An eligible entrant may use either entry method. Entry is limited to one per household per day. Multiple entries received on the same day by members of the same household, whether via write-in or Internet, are void.

Mail-In Entry: To enter the sweepstakes via the mail, mail your name, address, daytime telephone number, age and e-mail address (if any) on a 3" x 5" piece of paper to: "Bankrate.com's Home Improvement Sweepstakes" P.O. Box 13107, N. Palm Beach, FL, 33408-9919. Mail-in entries must be received by the last day of the Entry Period.

Online Entry: To enter the sweepstakes via the Internet, go to:
http://www.bankrate.com/brm/sweeps/HomeImprovement/entry.asp
and complete the online entry form and submit during the Entry Period.


CONDITIONS OF ENTRY: Eligible entrants must enter via either the mail-in or online methods as described above. Incomplete entries are void. By entering, entrants acknowledge compliance with these Official Rules, including all eligibility requirements. An online entrant must be the registered subscriber of the e-mail account by which the entry is made. All entries become the property of Bankrate, Inc.

HOW TO WIN:The drawing for the Grand Prize Winner will be conducted on or around July 14, 2003, by a representative of Bankrate, Inc., Inc. from among all eligible entries received during the Entry Period. The decision of the designated representative of Bankrate, Inc. shall be final and binding. The odds of winning will be determined by the number of eligible entries received. The Grand Prize Winner must meet all eligibility requirements including the execution and return of all necessary releases and the required Affidavit of Eligibility and Release of Liability for Participation and Publicity.

VALUE OF PRIZE: Maximum value of the Grand Prize: $5,000. Any taxes due on the Grand Prize won will be the sole responsibility of the Grand Prize Winner.

WINNER: The Grand Prize Winner will be notified via e-mail on or around July 14, 2003. The Grand Prize must be claimed by August 4, 2003 or alternative Grand Prize Winner will be selected.
Bankrate, Inc. will issue the Grand Prize check within four (4) weeks of receipt of executed receipts, affidavits of eligibility, and signed releases.
The Grand Prize Winner will be required to sign an Affidavit of Eligibility and Release of Liability for Participation and Publicity prior to and as condition of acceptance of the Grand Prize. Failure to return documents as specified, or if prize notification is returned as undeliverable will result in the entry being disqualified and an alternative Winner selected.


PUBLICITY:Except where prohibited, participation in the Sweepstakes constitutes winner's consent to Bankrate.com's use of winner's name, likeness, voice, opinions, hometown and state for promotional purposes in any media without further payment or consideration.

DATA COLLECTION: Bankrate.com collects personal information from you when you enter the Sweepstakes via the online entry method described above. Bankrate reserves the right to share with, or loan, rent and/or sell to its affiliates and third parties, the personally identifiable information that you submit for entry in the Sweepstakes. If you do not want your personal information shared, loaned, rented, or sold to Bankrate's affiliates and third parties and would like to enter the sweepstakes, please enter via our mail-in method:

GRAND PRIZE WINNER NAME OR OFFICIAL RULES: For the names of the Grand Prize Winner, available after July 14, 2003, or a copy of these Official Rules, mail a self-addressed stamped envelope (residents of VT need not include return postage) to Bankrate.com's "Home Improvement" Sweepstakes, 11811 U.S. Highway One, N. Palm Beach, FL, 33408. Please specify whether you are requesting the name of the Grand Prize Winner or the Official Rules. Requests received after August 4, 2003 will not be honored.

GENERAL CONDITIONS: Bankrate.com reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond reasonable control impairs the integrity of the Sweepstakes, as determined by Bankrate.com in its sole discretion. In such event, Bankrate.com reserves the right to award the Grand Prizes at random from among the eligible entries received up to the time of the impairment. Bankrate.com reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage Bankrate.com's Web site or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws and, should such an attempt be made, Bankrate.com reserves the right to seek damages from any such person to the fullest extent permitted by law. Bankrate.com's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

RELEASE: By receipt of any Sweepstakes prize, winner agrees to release and hold harmless Bankrate, Inc., their related companies, and each of their respective officers, directors, employees and agents from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize.

LIMITATIONS OF LIABILITY: Bankrate.com is not responsible for: (1) incorrect or inaccurate transcription of entry information or late, lost, stolen, illegible, incomplete, misdirected, or postage due entries, or entries received through impermissible or illegitimate channels, all of which will be disqualified; (2) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any service; (4) unauthorized human intervention in any part of the entry process or the Sweepstakes; (5) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (6) any injury or damage to persons or property, including but not limited to entrant's computer, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or from downloading any material from Bankrate.com's Web site, regardless of whether the material was prepared by Bankrate.com, or a third party, and regardless of whether the material is connected to Bankrate.com's Web site by a hypertext link.

DISPUTES:Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts of record in the State of Florida in Palm Beach County or the United States District Court, Southern District of Florida; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Bankrate.com in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida. All federal, state and local laws and regulations apply.
