George Saenz, the Bankrate.com Tax Talk columnistGetting help fighting the IRS

Dear Tax Talk,
The Internal Revenue Service has labeled me as self-employed and I am not. I have been retired for over 10 years. I have written the IRS showing that I do not have income, only interest and Social Security and retirement from husband who was in the Army. They don't believe me. They keep sending me a bill, which I don't understand. I ask them where they get their figures and they don't answer me. Help! I am at my wit's end. Can you direct me to someone who can help me? -- Flo

Dear Flo,
I've worked with the IRS for years and I have found out a few things:

      1. They just don't label people without reason.
      2. They generally don't believe anybody, including themselves.
      3. They don't know where they get their figures.

Since you seem to have made good faith efforts to resolve your problem, you need to get in touch with the Taxpayer Advocate's office.

This independent branch of the agency was established a few years ago to help taxpayers cut through levels of IRS red tape and resolve matters that have dragged on too long. The good thing about this service is that you have a real live individual assigned to your case. This person will see the problem through to its conclusion.

To start the process call Taxpayer Advocate at 1-877-777-4778 with all pertinent information, such as years involved and all the various contact attempts you've made. Try not to despair. I've found that when you can get someone to help you with a problem, it tends to reduce the emotional level.
